1. Acceptance of These Terms

These Terms of Use (“Terms”) are a binding agreement between you and Boulder Lux Home (“Boulder Lux Home,” “we,” “us,” or “our”). By accessing or using boulderluxhome.com (the “Site”), you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Site.

2. Purpose of the Site

The Site provides general information about a residential rental property and allows prospective renters to review amenities, estimated pricing, availability information, and submit inquiries. The Site is intended for adults who can enter into a legally binding agreement.

3. No Rental Offer or Agreement

Site content, availability statements, pricing, incentives, calculator results, photographs, floor plans, measurements, distances, and descriptions are provided for general informational purposes. They do not constitute an offer, reservation, lease, guarantee of availability, or representation that any applicant will be approved.

All rental terms—including dates, price, deposits, fees, furnishing, occupancy, screening, the one-month-free incentive, and property rules—must be confirmed in a separate written agreement signed by the applicable parties. If these Terms or Site content conflict with a signed rental agreement, the signed rental agreement controls.

4. Pricing Calculator and Incentives

The pricing calculator provides an estimate based on the selections entered and the pricing displayed at that time. Estimates may not include deposits, taxes, utilities, services, damages, or other charges unless expressly stated. The 12-month “one month free” incentive applies to one month of base rent; furnishing charges remain payable for the full stay unless a written rental agreement states otherwise. Incentives are subject to availability, eligibility, change, or withdrawal before a rental agreement is signed.

5. Inquiries and User Information

You agree that information you submit is accurate, current, and not misleading. Submitting an inquiry does not create a landlord-tenant, broker, agency, fiduciary, or other contractual relationship and does not reserve the property. You authorize us to respond using the contact information you provide. Our handling of personal information is described in the Privacy Policy.

6. Fair Housing and Lawful Use

We support equal housing opportunity and intend to comply with applicable federal, state, and local fair housing and anti-discrimination laws. The property and Site may be used only for lawful purposes. Nothing on the Site waives any non-waivable right or obligation under applicable landlord-tenant, consumer-protection, privacy, or fair-housing law.

7. Permitted Use

You may use the Site for personal, noncommercial purposes related to evaluating or inquiring about the property. You may not:

• Use the Site unlawfully, fraudulently, or to harm another person.
• Attempt to gain unauthorized access to the Site, its systems, or related accounts.
• Introduce malicious code, interfere with Site operation, or circumvent security controls.
• Scrape, copy, republish, sell, or exploit substantial portions of the Site without written permission.
• Impersonate another person or submit false, abusive, or infringing content.

8. Intellectual Property

The Site and its text, design, branding, graphics, photographs, video, software, and other content are owned by or licensed to Boulder Lux Home and are protected by applicable intellectual-property laws. We grant you a limited, revocable, nonexclusive, nontransferable right to access and use the Site for its intended personal purpose. No other rights are granted.

9. Third-Party Links and Services

The Site may link to maps, local attractions, photo sources, or other third-party websites. We do not control and are not responsible for third-party content, availability, security, or privacy practices. A link does not imply endorsement. Your use of third-party services is governed by their terms and policies.

10. Site Availability and Changes

We may change, suspend, or discontinue any part of the Site at any time. We aim to keep information accurate but do not promise that the Site will always be available, complete, current, secure, or error-free. You are responsible for independently confirming information material to your rental decision.

11. Disclaimer of Warranties

To the fullest extent permitted by law, the Site is provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of accuracy, availability, merchantability, fitness for a particular purpose, title, and non-infringement. Some jurisdictions do not allow certain warranty exclusions, so portions of this section may not apply to you.

12. Limitation of Liability

To the fullest extent permitted by law, Boulder Lux Home and its owners, operators, representatives, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, use, or opportunity, arising from or related to the Site. Our aggregate liability for claims arising solely from use of the Site will not exceed the greater of $100 or the amount you paid us specifically to use the Site during the 12 months before the event giving rise to the claim.

These limits do not exclude liability that cannot lawfully be excluded, and they do not alter rights under a signed rental agreement.

13. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Boulder Lux Home and its owners, operators, and representatives from claims, damages, liabilities, and reasonable costs arising from your unlawful misuse of the Site, your violation of these Terms, or content you submit that violates another person’s rights.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law rules. Subject to any non-waivable law or controlling written agreement, disputes relating solely to the Site will be brought in the state or federal courts located in Boulder County, Colorado, and you consent to their jurisdiction. This section does not deprive you of mandatory consumer protections available where you live.

15. Changes to These Terms

We may update these Terms by posting a revised version and changing the effective date. Changes apply prospectively when posted. Your continued use of the Site after an update means you accept the revised Terms.

16. General Terms

If any provision is held unenforceable, it will be modified to the minimum extent necessary and the remaining provisions will continue in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a transfer of the Site, property, or business. These Terms and the Privacy Policy are the entire agreement concerning use of the Site, but do not replace any separately signed rental agreement.

17. Contact Us
